No-fault divorce: Let's call the whole thing off

The New York State Senate has passed a bill adopting no-fault divorce, and the Assembly is under pressure this week to follow suit to terminate a law in which a couple must agree upon a divorce, or one spouse must prove the other guilty of a major fault, such as adultery or abuse.

True, 49 other states have adopted no-fault divorce. But New York would be unwise to discard a law has produced almost the lowest divorce rate in America. With 135,000 marriages in 2008, New York had only 52,300 divorces, for a divorce rate of 38.7%. Only two states have slightly lower rates.
